All merchandise is sold subject to the following terms and conditions:
1. The sale represented by this invoice is subject to the terms and conditions stated herein, which constitute the entire agreement between Seller and Purchaser. No representation, promise, or condition not set forth herein has been relied upon by Purchaser or will be binding on either party. These terms and conditions will prevail over any and all terms and conditions set forth in any documents issued by Purchaser.
2. Unless otherwise noted, Purchaser will pay cash on delivery basis (C.O.D.) for all products. Purchaser will forfeit deposits on products not fully paid and picked up within 30 days of the date of order. Seller will not be liable for any loss or damage Purchaser may suffer as a result of delays in filling orders. Unless otherwise noted, sales prices do not include, and Purchaser is responsible for and agrees to pay (unless Purchaser provides Seller a copy of a valid exemption certificate), all sales, use, value added, excise and other federal, state or local or foreign taxes, import or customs fees and duties associated with an order, however designated, except for taxes on Seller income. If credit is granted, and this invoice is not paid within thirty days, then interest shall accrue at the highest rate allowed by law.
3. Unless otherwise noted, all shipments are made FOB Seller shipping point. If delivery of the products to Purchaser is required, delivery takes place when physical possession of the products is given to the Purchaser or to a carrier for shipment to the Purchaser, whichever comes first. Unless otherwise noted, sales prices do not include freight, shipping or handling charges. Title and risk of loss and responsibility for the products passes to Purchaser upon delivery.
4. If any check tendered by Purchaser is returned to Seller unpaid by the bank for any reason whatsoever, Seller may charge Purchaser the amount of the check plus a reasonable service fee which will be the greater of twenty five dollars ($25.00) or one percent (1%) of the check amount. Such service fee will be in addition to all other remedies provided by law.
5. Sales are final and no returns are allowed. In the event that Abamaster accepts a customer return, prior written authorization from Abamaster is required. The buyer will be responsible for all shipping and handling arrangements and charges. Returns are subjected to a 30% restocking fee. Merchandise must be returned in its original packing material and be in new condition. Used merchandise cannot be returned. Custom or made-to-order merchandise cannot be returned
6. All products are sold subject to the manufacturer warranty, which varies from manufacturer to manufacturer, and Purchaser will make all warranty claims directly to the manufacturer. IT IS EXPRESSLY AGREED THAT NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, HAVE BEEN OR ARE MADE BY SELLER EXCEPT AS STATED HEREIN, AND SELLER MAKES NO WARRANTY, EXPRESS OR IMPLIED, AS TO THE MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE OF PRODUCTS.
7. SELLER TOTAL LIABILITY FOR ALL CLAIMS OF ANY KIND, INCLUDING WITHOUT LIMITATION BREACH OF WARRANTY OR OTHER BREACH OF CONTRACT, NEGLIGENCE AND STRICT LIABILITY IN TORT, FOR LOSS OR DAMAGE ARISING OUT OF, CONNECTED WITH OR RESULTING FROM THE SALE OF PRODUCTS BY SELLER, OR THE PURCHASE USE OR PERFORMANCE OF THE PRODUCTS WILL IN NO EVENT EXCEED THE PURCHASE PRICE PAID FOR SUCH PRODUCTS. IN NO EVENT WILL SELLER BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS. PURCHASER ACKNOWLEDGES THAT WITHOUT ITS AGREEMENT TO THE LIMITATIONS CONTAINED HEREIN, THE PRICES CHARGED FOR THE PRODUCTS WOULD BE HIGHER.
8. This invoice is subject to the laws of Florida. Any action brought or held on the basis of this invoice will be brought and held in the courts located in Miami-Dade County, Florida. In any action or suit arising out of this invoice, the losing party will pay to the prevailing party reasonable attorney fees and all other costs and expenses.
9. Purchaser acknowledges being given the opportunity to read these terms and conditions before signing this invoice.
Shipping and Handling Guidelines
Shipping charges apply to any address in the Continental United States of America. Since our online store can not process orders outside the continental U.S.A., please contact Abamaster's customer service by phone at (305)325-8888 or via email at sales@abamaster.com to receive a shipping/handling cost quote.
While Abamaster makes every effort in packing and filling your order correctly, an occasion may arise where merchandise may be damaged or lost in transit to your location. Before the delivery person departs your location, you are to required to :
1) Inspect your merchandise and note any concealed damage on the bill of lading or delivery ticket. Any merchandise damage must be documented with the freight delivery driver before the driver departs your location.
2) Verify that all packages were delivered as stated in the packing list and that shipment contains appropriate merchandise.
3) The buyer is required to make necessary arrangements to have sufficient personnel or equipment present to unload the products delivered, as the drivers are not required to provide assistance unloading your order.
Abamaster is not responsible for any damaged merchandise or incomplete orders accepted and signed for at the time of delivery. Do not return any merchandise to Abamaster without prior written authorization from Abamaster. Unauthorized returns will not be processed.

Shipping Methods and Merchandise Cost
Buyer pays for all shipping and handling costs. In addition, the buyer will pay for any sales tax charges when applicable or required by law.
Orders are shipped via ground shipping. Oversized, heavy equipment and orders which require special handling will be shipped via common carrier.
Due to our vast inventory, orders are processed and shipped within 1-5 business days after receiving a payment approved order. Your order should arrive within 3-10 business days after the ship date via ground shipping. Expedited shipping is available and costs more than standard shipping. Please contact Abamaster for a shipping rate quote. In case of shipping cost errors,an Abamaster Customer Service Representative will contact you with a revised shipping cost for your approval before processing your order.
